Welcome to our website www.agrisantalucia.com. Access to and use of our site are activities governed by these General Conditions of Use. Access to and use of this website as well as the purchase of products on our e-commerce website presuppose that you have read, understood and accepted these General Terms of Use.
Conditions of Use
The offer and sale of products on the www.agrisantalucia.com website are governed by the following General Terms and Conditions. Purchase transactions are governed, inter alia, by the provisions of Legislative Decree no. 206 of 06.09.2005 (Consumer Code) pursuant to which:
1) online sales contract” means the distance contract, i.e. the legal transaction concerning movable goods and/or services entered into between SANTA LUCIA VINI (VAT no. 04742900485), with head office in Via Varna 119, Gambassi Terme (FI) in the person of its legal representative pro tempore and a consumer, through the online service online www.agrisantalucia.com, as part of a distance selling system. This contract exclusively employs the distance communication technology known as the Internet;
2) Consumer’ shall mean a natural person of full age who is acting for purposes which are outside his or her trade, business or profession.
Acceptance of General Terms and Conditions
All contracts will be concluded directly by accessing the website corresponding to the address www.agrisantalucia.com, where the customer can conclude the contract for the purchase of the desired good and/or product by carefully following the instructions and procedures provided.
Access to and use of the Site, as well as the purchase of any product and/or service on the Site, are governed by these terms and conditions of sale, which are presumed to be known and accepted by the ‘consumer’.
These general terms and conditions of sale may be updated or amended at any time by SANTA LUCIA VINI, which will give notice thereof via the pages of the website. With his fulfilment, all communication obligations will be fulfilled and perfected.
By sending electronic confirmation of his or her purchase order, the consumer unconditionally accepts and undertakes to observe, in his or her dealings with SANTA LUCIA VINI, the general terms and conditions of sale, including the payment terms and conditions set out below, declaring that he or she has read and accepts all the information provided to him or her.
Prices and purchasing methods
All sales prices of products displayed and indicated on the site Internet www.agrisantalucia.com, for which they constitute an offer to the public pursuant to Article 1336 of the Italian Civil Code, are inclusive of VAT and all other sales taxes.
The total cost of shipping and transport will be clearly indicated and displayed before the order is finalised.
The purchase contract is finalised by the exact completion and consent to the purchase manifested through the adhesion given “on line”, subject to the successful completion of the payment.
The ‘consumer’ must pay for the goods ordered using the payment method indicated ‘online’ at the time of purchase and other payments will not be accepted.
Shipping and delivery of products
SANTA LUCIA VINI, by handing over the selected products to its trusted couriers for shipment, shall not be liable for any delivery problems caused by errors in the communication of personal data and delivery addresses caused by the customer, as well as for any loss and/or damage to the goods.
SANTA LUCIA VINI will process orders placed within 7 working days and, in any case, the purchased goods will be delivered within the terms set out in art. 54 of Legislative Decree 205/06, within 30 days from the day after the consumer placed the order. No responsibility can be attributed to SANTA LUCIA VINI for delayed or non-delivery attributable to force majeure or fortuitous events.
The consumer is required to verify, upon receipt, the conformity of the product delivered to him/her with the order placed; only after such verification, and subject of course to the right of withdrawal provided for by law, the consumer must sign the receipt documents. By filling in the personal data sheet in the registration procedure necessary to activate the process for the execution of this contract and the relative further communications, the consumer and/or customer authorises SANTA LUCIA VINI to communicate their non-sensitive personal data (residence, telephone number) to the couriers and/or shippers of trust used for the delivery of the purchased goods in order to allow the necessary procedures for their delivery.
SANTA LUCIA VINI, through its trusted courier, ships throughout Italy, including the islands. Product delivery times are two to three working days in Italy and an additional two working days for the islands.
Products available for sale
The customer may purchase the products displayed in the e-catalogue prepared by SANTA LUCIA VINI SANTA LUCIA VINI undertakes to send the customer/consumer confirmation of the order as a guarantee that all the products ordered are available and in optimal condition. Payment for the ordered goods shall be made only after receipt of the order confirmation.
Responsibility
SANTA LUCIA VINI accepts no liability for disservices attributable to force majeure, such as, by way of example, accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that prevent, in whole or in part, the execution of the contract within the time agreed in the contract.
SANTA LUCIA VINI shall not be liable to any party or third party for any damages, losses and costs incurred as a result of the non-performance of the contract for the aforementioned reasons, the customer being only entitled to a refund of the price paid.
Similarly, SANTA LUCIA VINI is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards, cheques and other means of payment when paying for products purchased. SANTA LUCIA VINI, in fact, at no time during the purchase procedure is it able to know the customer’s credit card number which, by opening a secure connection, is transmitted directly to the bank service manager.
Guarantees and service modes
Should the products ordered prove to be defective, it is the consumer’s obligation to report the defect in writing (by e-mail to info@agrisantalucia.com) within eight days of delivery of the goods, under penalty of forfeiture.
In order to request a replacement product, the consumer must make a special complaint following the procedure indicated above; SANTA LUCIA VINI may authorise the return of the product for verification, following notification of acceptance of the complaint.The risks and expenses related to the transport of the goods for return shall be borne by the sender/consumer. If the defect complained of is found, SANTA LUCIA VINI will carry out the agreed remedy within a reasonable period of time. SANTA LUCIA VINI, reserves the right to charge the customer for any expenses incurred for the verification of the product and for the new shipment of the same, if it is found to be intact and free of the defects complained of, contrary to what has been declared by the consumer.

Customer Obligations
Once the online purchase procedure has been completed, the consumer undertakes and commits to print and keep these general terms and conditions, which, moreover, he/she will have already read and accepted as a compulsory step in the purchase, as well as the specifications of the product to be purchased, in order to fully satisfy the condition set forth in Articles 52 and 53 of Legislative Decree 205/06.
It is strictly forbidden for the consumer to enter false and/or invented and/or fictitious data in the registration procedure required to activate the process for the execution of this contract and the related further communications; the personal data, address, telephone number and e-mail address must be exclusively the consumer’s own real personal data and not those of a third party, or fictitious data.
It is expressly forbidden to enter the data of third parties. SANTA LUCIA VINI reserves the right to prosecute any violation and abuse, in the interest and for the protection of all consumers. The consumer indemnifies SANTA LUCIA VINI from any liability deriving from the issue of incorrect tax documents due to errors in the data provided by the customer, as he/she is solely responsible for their correct entry.
Right of withdrawal and complaints
Pursuant to Article 64 of Legislative Decree No. 205/06, the consumer may exercise the right of withdrawal and return the product received, in accordance with the terms and procedures set out below.
A consumer who, for justified reasons, is not satisfied with the purchase made has the right to withdraw from the contract concluded, within a period of 8 days from the date of the invoice.
If the end consumer wishes to exercise the right o f withdrawal, he/she must make the return request by sending an email to info@agrisantalucia.com and confirming his/her wish to withdraw. He or she must then return the product by direct delivery or shipment to the return address of SANTA LUCIA VINI Costs and procedures for returning products are the responsibility of the consumer. Items must be returned and received by the Customer Service intact and in the same state in which they were received, with the original packaging and product data bands intact and any other material that forms part of the packaging.
In the event that all the conditions and obligations of the consumer set out in the previous points have been met, SANTA LUCIA VINI will refund the sales price of the purchased item by bank transfer to the current account indicated by the customer/consumer, within 30 working days from the date of receipt of the goods by our logistics department.
Terms of Payment
By filling in the appropriate space on the website, the customer and/or client may choose whether to pay the amount due by cash on delivery (payment on delivery, additional cost 5 Euros + VAT) or by bank transfer in advance. In both cases SANTA LUCIA VINI, reserves the right to confirm to the customer/consumer the final amount of the order, after ascertaining the actual availability of all the products ordered. This is in the primary interest of the consumer/customer.
Should the consumer make use of the right of withdrawal, as provided for in these Terms and Conditions, the amount to be refunded will be by Bank Transfer.
Express termination clause
SANTA LUCIA VINI, has the right to terminate the contract entered into by simply notifying the consumer and/or customer with adequate and justified reasons; in this case, the customer shall only be entitled to a refund of any sum already paid.
The obligations assumed by the consumer in these terms and conditions (CUSTOMER OBLIGATIONS) as well as the guarantee of the successful completion of the payment made by the customer with the means set out in the PAYMENT TERMS and CONDITIONS, are essential, so that by express agreement, the customer’s failure to fulfil any one of these obligations will result in the legal termination of the contract pursuant to art. 1456 of the Italian civil code, without the need for a court ruling, without prejudice to SANTA LUCIA VINI’s right to take legal action for further compensation for damages.
Jurisdiction and competent court
All disputes relating to the application, execution, interpretation and breach of purchase contracts concluded “on line” through the website www.studioceccanti.it are subject to Italian law; these general terms and conditions refer to the rules laid down in the Civil Code, as well as to Legislative Decree 205/06.
For any dispute between the parties concerning this contract, the Court in whose district the consumer has his domicile shall have jurisdiction; for all other disputes the Court of Florence – Italy shall have exclusive jurisdiction.
